These Terms & Conditions (“Terms”) govern your use of Jazz Drive, the cloud storage and file management service provided by Pakistan Mobile Communications Limited (“Jazz”) in collaboration with Switch Communications (Pvt.) Ltd (“Vendor”). By accessing or using Jazz Drive, you agree to these Terms. If you do not agree, please do not use the Service.

1. Service Overview

1.1 Jazz Drive is a cloud-based storage and file management service that allows you to store, access, and manage your personal files across devices.

1.2 Jazz provides access/connectivity, while the Vendor (Switch Communications Pvt. Ltd) provides technical operations, backend support, and storage management.

1.3 Your use of Jazz Drive is strictly subject to these Terms and applicable laws.

2. Registration & Account

2.1 To use Jazz Drive, you must register an account using your Jazz number.

2.2 The account is strictly personal and cannot be transferred or shared.

2.3 You are responsible for maintaining accurate information and securing your login credentials. Any misuse due to negligence will be your responsibility.

2.4 If your credentials are compromised, you must immediately notify customercare@switch.com.pk.

3. Subscription, Payments & Billing

3.1 Jazz Drive is a paid subscription service. Charges will apply as per the package selected at the time of subscription, on a recurring basis.

3.2 The applicable subscription amount will be deducted directly from your Jazz account balance (for prepaid users) or added to your monthly bill (for postpaid users), depending on your account type.

3.3 Failure to maintain sufficient balance or clear dues may result in suspension or termination of service in line with Clause 4.

4. Suspension, Grace Period & Data Retention

4.1 If subscription charges remain unpaid, your Jazz Drive account will be suspended after 45 days of non-payment.

4.2 During suspension, you may log in and retrieve/download your previously stored files, but you will not be able to upload or add new content.

4.3 If charges remain unpaid beyond the suspension period, your account will enter a 45-day grace period for final data retrieval.

4.4 After the grace period, all data will be permanently deleted without recovery, and Jazz/Vendor shall bear no responsibility for such deletion.

5. Usage Policy

5.1 You retain ownership of all content uploaded to Jazz Drive.

5.2 You may not use Jazz Drive to upload, share, or store:

• Illegal, obscene, defamatory, or offensive content.
• Content that infringes on intellectual property or privacy rights.
• Material harmful to system security (malware, viruses, etc.).

5.3 Any misuse may result in immediate suspension/termination of your account without refund.

6. Data Security & Privacy

6.1 Your personal data and stored content will be handled in accordance with the Jazz Privacy Policy.

6.2 Jazz Drive and its Vendor will not access or share your content with third parties except:

• As required by law, regulatory bodies, or valid government requests.
• For service maintenance and performance monitoring (without accessing personal content).

7. Termination of Account

7.1 You may unsubscribe at any time by contacting customercare@switch.com.pk, or through the Jazz Drive app, website, or other available unsubscription methods.

7.2 Any fees already paid are non-refundable.

7.3 Jazz may terminate your account if you breach these Terms.

8. Intellectual Property

8.1 Jazz and Switch Communications Pvt. Ltd retain all ownership of Jazz Drive software, platform, and related technology.

8.2 You may not copy, modify, reverse engineer, or redistribute any part of the service.

9. Disclaimer & Liability

9.1 Jazz Drive is provided on an “as is” and “as available” basis.

9.2 Jazz and Vendor do not guarantee uninterrupted or error-free service.

9.3 Jazz and Vendor shall not be liable for any direct or indirect damages, including data loss, due to service disruptions, account suspension, or termination in accordance with these Terms.

10. General Terms

10.1 Jazz reserves the right to update these Terms from time to time. Continued use of the service implies acceptance of updated Terms.

10.2 Notices to users may be sent via SMS, email, or in-app notifications.

10.3 Any disputes shall be governed by the laws of Pakistan.
